Terms of Service

These Terms of Service ("Terms") govern your use of the TwaBot platform operated at twabot.com. By creating an account or using our services, you agree to these Terms.

1. Service Description

TwaBot is a Software-as-a-Service (SaaS) platform that provides AI-powered WhatsApp automation for businesses. Our services include AI chatbot auto-replies, bulk broadcast messaging, contact management, conversation tracking, and analytics dashboards.

2. Account Registration

  • You must provide accurate and complete information during registration.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must be at least 18 years old and have the authority to bind your business to these Terms.
  • One business account per WhatsApp Business number.
  • You are responsible for all activity that occurs under your account.

3. Free Trial

New accounts receive a 3-day free trial on the Starter plan. No credit card is required. After the trial expires, you must subscribe to a paid plan to continue using the service. During the trial, all features of the Starter plan are available.

4. Subscriptions & Payments

  • Subscriptions are billed monthly in Indian Rupees (INR).
  • Payments are processed securely through Razorpay.
  • Your subscription renews automatically each month unless cancelled.
  • You can upgrade, downgrade, or cancel your plan anytime from the dashboard.
  • Plan limits (messages, contacts, features) are enforced as per your active subscription.

5. Acceptable Use

You agree not to use TwaBot to:

  • Send spam, unsolicited messages, or messages violating WhatsApp's Business Policy
  • Harass, threaten, or abuse any person
  • Send illegal, fraudulent, or misleading content
  • Impersonate any person or entity
  • Attempt to hack, reverse-engineer, or disrupt the platform
  • Exceed your plan's message or contact limits through manipulation
  • Use the platform for any activity that violates Indian law or regulations

Violation of these rules may result in immediate account suspension or termination without refund.

6. WhatsApp Business API Compliance

You must comply with Meta's WhatsApp Business Policy and Commerce Policy at all times. TwaBot is not responsible for any action taken by Meta/WhatsApp against your business number, including bans or restrictions, that result from your messaging practices.

7. AI-Generated Content

Responses generated by the AI chatbot (powered by OpenAI or Google Gemini) are automated and may not always be accurate. You are responsible for configuring your system prompt appropriately and monitoring conversations. TwaBot is not liable for any damages caused by AI-generated responses sent to your customers.

8. Broadcasts

Bulk broadcast functionality is available on Growth and Pro plans. You are solely responsible for ensuring that your broadcast messages comply with applicable laws, including but not limited to:

  • Obtaining proper consent from recipients before sending messages
  • Providing opt-out mechanisms where required
  • Compliance with the Telecom Commercial Communications Customer Preference Regulations (TCCCP) in India

9. WhatsApp Number Reconfiguration

TwaBot allows you to change ("reconfigure") the WhatsApp Business number attached to your account — for example, when your number has been restricted or banned by Meta, when you are migrating from a personal to a business number, or when your number is lost. Reconfiguration is subject to the following policy:

  • Free Reconfigures (per 90-day window):
    • Starter plan — 1 free reconfigure
    • Growth plan — 1 free reconfigure
    • Pro / Enterprise plan — 2 free reconfigures
  • Paid Reconfigures (after free allowance is used):
    • 2nd paid reconfigure in 90 days — ₹1,000 + GST
    • 3rd paid reconfigure in 90 days — ₹1,500 + GST
    • 4th or more in 90 days — requires manual support review; may be refused at TwaBot's sole discretion
  • Reconfiguration has a minimum 24-hour cooldown between successful attempts. This protects you and your customers from accidental repeated switches.
  • Reconfiguration fees are non-refundable once the new number is successfully attached, as Meta's embedded-signup flow consumes resources on their side that we cannot reverse.
  • We reserve the right to refuse reconfiguration if we reasonably believe it is being used to evade a Meta ban, launder spam, or circumvent WhatsApp Business Policy. In such cases we may suspend the account instead of processing the reconfigure.

9.1 Data continuity after reconfigure

Your account data — including agents, contacts, conversation history, AI settings, flow automations, pricing, subscription, and usage analytics — is tied to your business account, not to the WhatsApp phone number. Reconfiguring the number does not delete any of this data.

9.2 Old-number conversations and templates

After a reconfigure:

  • Broadcast templates approved under the old WABA (WhatsApp Business Account) cannot be carried over to the new WABA. This is a Meta platform limitation, not a TwaBot choice. You will need to re-submit templates for approval under the new WABA. Templates from the previous WABA are archived for reference but not sendable from the new number.
  • Conversations that were active before the reconfigure are retained in read-only form and tagged as belonging to the previous number era. New outbound messages cannot be sent on threads that were opened against the old number because WhatsApp ties the 24-hour customer-service window to a specific phone-number-id.
  • Incoming messages from customers who still have your old number saved will be silently dropped by our webhook handler, as Meta will not deliver them to the new number. We recommend broadcasting a "we've moved to a new number" opt-in template from the new number within your first 24 hours after reconfigure.

9.3 Compliance pass-through

When you initiate a reconfigure you confirm, on behalf of your business, that:

  • You will not use the new number to continue activity that violates Meta's WhatsApp Business Policy, Commerce Policy, or any applicable law.
  • You have a legitimate business reason for the change (e.g., number restricted by Meta, number lost, business restructure, quality-rating issues).
  • You understand that Meta may independently apply a review, probation, or ban to the new number if it detects the same violating pattern. TwaBot is not responsible for any such action by Meta.
  • If the old number is later un-restricted by Meta, re-attaching it will count as another reconfigure against the 90-day window.

9.4 Audit logging

Every reconfigure is logged with a timestamp, the user who initiated it, their IP address and browser user agent, a before/after snapshot of the phone number and WABA id, the stated reason, and the new number that replaced the old one. These logs are retained for 3 years and may be produced by TwaBot in response to a lawful request or a Meta dispute. You consent to this logging by initiating a reconfigure.

10. Data Ownership

  • Your Data: You retain ownership of all data you provide, including business information, conversation history, contact lists, and broadcast templates.
  • Our Platform: TwaBot retains all rights to the platform, its code, design, features, and intellectual property.
  • We do not claim ownership of your data or your customers' data.

11. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We are not liable for downtime caused by scheduled maintenance, third-party API outages (WhatsApp, OpenAI, Gemini), hosting provider issues, or force majeure events.

12. Limitation of Liability

To the maximum extent permitted by law, TwaBot shall not be liable for any indirect, incidental, special, consequential, or punitive damages including loss of profits, revenue, data, or business opportunities arising from your use of the service. Our total liability shall not exceed the amount paid by you in the 3 months preceding the event giving rise to the claim.

13. Account Termination

  • You may cancel your account at any time from the dashboard.
  • We may suspend or terminate your account for violation of these Terms.
  • Upon termination, your data will be retained for 30 days and then permanently deleted.

14. Modifications

We reserve the right to modify these Terms at any time. Significant changes will be communicated via email. Continued use of the platform after changes constitutes acceptance. If you disagree with updated Terms, you should stop using the service and cancel your subscription.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.
